Data protection policy

This data protection policy explains how the Federal Criminal Court collects, manages and handles personal data submitted in electronic or paper form.

Personal data submitted by post or electronically will only be used to answer your request.

By contacting the Federal Criminal Court electronically or in paper form, you accept the terms described in this data protection notice.

1. Area of application
Electronic submissions include the use of the contact form as well as all other electronic communications, such as e-mail.

Paper submissions include all communications in paper format.

This data protection notice does not apply to the processing of personal data in court proceedings and proceedings according to federal procedural laws; this processing and the rights of data subjects are regulated by the applicable procedural law (Art. 2 para. 3 DPA).

2. Data controller
The data controller is the Federal Criminal Court in Bellinzona.

3. Data collection
By contacting the Federal Criminal Court electronically or in form paper, you consent to the collection and processing of your personal data.
This includes the following data in particular:

  • When a request is sent electronically, your IP address.
  • Other personal data submitted to the Federal Criminal Court, either by electronic or paper form, may also be registered. Specifically, the following data: gender, first name, last name, e-mail address, mailing address, telephone number, language and date of birth.

This data is processed exclusively to respond to your request.

4. Consent
Your personal data are processed on the basis of your consent (Art. 34 al. 4 let. b FADP, SR 101).

5. Purpose of data collection
The collected personal data are used solely to answer your questions.

6. Data storage
The collected personal data may be stored electronically and assigned to a dossier number.

Your request and any associated dossiers will be durably preserved.

If the transmitted data have legal, political, economic, historical, social or cultural value, they may be archived in accordance with the Federal Act on archiving (ArchA, SR 152.1).

The data are stored in Switzerland.

7. Data sharing
The collected personal data are not shared, sold, rented or provided to third parties, except to answer your requests or fulfil legal obligations.

8. Data security
The Federal Criminal Court ensures, by taking appropriate technical and organizational measures, that the security of personal data is adequate.

9. Changes to the data protection policy
We reserve the right to modify this data protection notice at any time. Any changes will take effect as soon as the updated version is published on the Federal Criminal Court’s website.
